Probably. I wonder if the opposition at Bristol and Stansted used used the same arguments as GALBA. If so the ministers decision on these will be a good indication of how he will rule on Leeds.
The local authority seems to have all but withdrawn its defence of the STN appeal much to the chagrin of their version of GALBA. The appeal there is currently under way and STN's 'GALBA' has decided to put their opposition evidence to the public enquiry in writing only, despite being warned by the planning inspectors conducting the enquiry that it will carry less weight than oral evidence.

The main part of the BRS appeal - the public enquiry element - is not due until July so we shan't know the final outcome until towards the end of this year at the earliest. If BRS is successful with its appeal I anticipate further action by opponents by way of judicial review attempts.

The BRS opposition groups, there is more than one, have broadly used the same environmental arguments as GALBA.

It's really, how long is a piece of string? Normally the judicial review application has to be lodged within six weeks of the decision but the length of time to determine can vary according to the complexity. The linked guide says that in some circumstances the procedure can take months.

On another website I found this:

In 2018 3,957 claims for judicial review were lodged (commenced) in the High Court. However, most cases do not get very far, because a claimant must convince the court that they have an “arguable” case in order to be granted permission to proceed to a full hearing.

Only 184 cases, or about 5% of total cases commenced, reached a full oral hearing in 2018. The rest were mostly refused permission to proceed, withdrawn, or resolved out of court.

Of the cases that did proceed to a full hearing, the government body under challenge won 50% and lost 40%. The other cases were mostly withdrawn or have not yet reached a conclusion.


It seems from this that courts don't entertain judicial review applications lightly.

 
Its like car crash tv again, im genuinely shocked that this is how applications get approved or rejected and the total lack of knowledge by the councillors and how carol cunningham has to correct them on points that any intelligent person would know! I fear as so many councillors are still requiring answers to questions. Will this ever end!!!

I’ve given up on it, it’s possibly my WiFi but everything else is fine so not sure.

Hopefully these lunatics see sense and give full backing to LBA.
 
These councilors seem so confused, continually going round in circles as if they dont have a clue what there talking about, is there any brain cells in this plans panel today!
I agree, everything they're bringing up has already been discussed. Also, did I hear one councillor just say she didn't want any night flights? We've had night flying for years.

I think Carol Cunningham should be inducted into the House of Lords. She has done more “constructive” work for Leeds and the City Region on this Planning Application than Councillor Blake and the rest of the council. She has the patience of a Saint.
Most of the Councillors would struggle with dot-to-dot or Painting by Numbers.
Oh and to top it all off, I have already eaten half my supply of hot cross buns for the week and am high on caffeine because I am getting each sentence treated.

Well it looks like I'm off to Australia and New Zealand next year! Booked with BA from Manchester via Heathrow with a stop in Singapore and returning with Air New Zealand and BA via LAX to Heathrow. Will circumnavigate the globe and be my first trans-Pacific flight. First long haul flight with BA as well and of course Air NZ.
15 years at the same company was reached the weekend before last. Not sure how they will mark the occasion apart from the compulsory payirse to minimum wage (1st rise for 2 years; i was 15% above it back then!)
